R-Comp Interactive Terms and Conditions of Sale

These Terms and Conditions are effective from 1st October 2013 until further notice. R-Comp Interactive will hereafter be referred to as 'RCI'.

Your purchase is subject to these Terms and Conditions, whether you order via this website, or by telephone or post. Please read them carefully as they contain very important information about your rights and obligations, as well as warranty limitations that may apply to you.

Upon receipt of your order, RCI will contact you giving Formal Acceptance of the Order. A binding contract will be formed upon this Formal Acceptance.

1. Parties and Definitions

"We", "Us" or "Our" means R-Comp Interactive who is the seller of products and/or services. Our office is at 22 Robert Moffat, High Legh, Knutsford, Cheshire, WA16 6PS, England. We can be contacted by e-mail at rci@rcomp.co.uk, by phone on 01925 755043 or by fax on 01925 757377.

2. Product information and availability changes

Due to the nature of continuous technology developments, we may update, revise and/or discontinue products and prices at any time.

All orders are subject to the availability of products from our suppliers. Out of stock items will be shipped on a "first come, first served" basis when they come back into stock. Should a product be discontinued, we will contact you, and offer alternatives where appropriate. Where your choice of replacement part is more expensive, you may be asked to pay the difference.

In common with standard industry conventions all hard disc drives are specified in rounded decimal gigabytes (where 1 GB = 1,000,000,000 bytes). Computer operating systems display rounded binary gigabytes, after formatting (where 1 GB = 1,073,741,824 bytes). This is why, for example, an 80Gb hard drive will not display 80Gb of free disc space after formatting.

All monitor screens are measured diagonally and may not be the full visible screen (especially in the case of CRT monitors). All monitor screen images are simulated pictures.

3. Prices

We may revise prices for products listed as available at any time. A price remains valid only for the duration of the day of your quotation unless otherwise stated in writing. Any erroneous prices shall be void and of no effect. If you place an order for incorrectly priced products, the correct price will be notified to you and, if you wish to continue with the order, substituted in place of the incorrect price. Sometimes prices may change rapidly before we can update our website or other price lists. In these rare cases we will notify you of any changes and you can then decide whether you wish to continue with the order.

Unless stated otherwise, our prices include UK VAT at the current rate, and UK delivery (excluding Highlands and Islands), there are no hidden extras. For orders further afield, we will notify you of any additional delivery charges which will be charged at cost.

Orders outside the EU may attract local duty and other local taxes, levies or charges, for which RCI is not responsible.

4. Terms of Payment

RCI accepts payment by debit card, bank transfer, cheque or credit card. If paying by cheque or bank transfer, please contact us by telephone or email to ensure the correct amount. In those cases, your order will not be fulfilled until funds have cleared. Unless otherwise stated, debit cards will only be charged upon shipment of goods (you will be responsible for any charges incurred as a result of lack of funds). Due to the charges involved, credit card orders will be subject to a small additional surcharge (please contact us for details).

For credit card or debit card payments, you must provide your valid credit card number and other requested details when ordering. We will attempt to verify the validity of the credit card with the card's issuer and will contact you if it is declined. We will charge credit/debit cards just prior to shipment, unless you are notified otherwise.

5. Order Acknowledgment, Order Acceptance, Contract formation

If you order via our website, we will confirm your order (usually by telephone, but otherwise by email) including the Final Price. We will, at that time, give our Formal Acceptance of the Order.

Our contract with you is dependant and conditional upon our verification of availability and acceptance of both your order and your payment details. Please note that any Personal Information that you supply during your transaction with us is considered private and confidential, and will not be passed on to third parties without your consent.

6. Delivery

Delivery charges within the UK mainland (excluding Highlands and Islands) are included in the price quoted, unless stated otherwise. Charges to other destinations will be "at cost" and you will be notified of these fees. We will use our discretion in selecting a reputable carrier and appropriate means of delivery.

We aim to deliver promptly (normally within 7 days), but in case of supply problems there may be reasons for our inability to ship according to our target dates. Accordingly, any dates given for the delivery of products are estimates only and may be delayed by a few days. We would normally notify you in case of delay.

7. Software Licences

All software, including pre-loaded software contained in hardware products, is licensed to you subject to the relevant software end-user licence agreement or other terms included with the software and/or with the product. Software may not be disassembled, decompiled, reverse engineered, merged or combined with any other software, copied, translated, adapted, varied or modified (save as expressly permitted by applicable law) nor may it be distributed in any form.

Where individual software licence terms are not supplied, such as pre-installed software on the hard drive of a computer, the software is licensed on a non-exclusive, non-transferable, single user basis for use only with the accompanying product.

Some software products may require registration or activation during installation, such that system configuration cannot be completed otherwise. Such registered/activated software is non-refundable, because once activated, it becomes non-transferable.

8. Your Acceptance of Delivered Products

All products (unless stated otherwise [eg. second hand purchases]) leave RCI in undamaged, working order. If your order is delivered by carrier (eg. Parcel Force, Amtrak, Fed Ex), your signature upon receipt of goods absolves the carrier of any responsibility for damage in transit. Since we are unable to provide warranty for accidental damage, if you have not checked the goods, you should mark your consignment as UNCHECKED when signing.

9. Your Right to Cancel

Computer systems purchased from RCI are all unique, customized systems, built to order. They will contain software and hardware components which are non-transferable, some of which may require activation/registration during installation, after which they cannot be resold. As such, any returned or cancelled items may be subject to charges related to this and/or restocking costs. You will be responsible for all delivery fees. Please note, we do NOT accept unsolicited returns, therefore you MUST contact us before returning goods, so that we can allocate you a returns procedure.

10. Warranty

Unless otherwise stated, computer equipment purchased from R-Comp Interactive is supplied with a 1 year warranty covering component failure. Where possible we will endeavour to solve any problem you might have with our products by telephone or email. Where this is not possible, the machine may have to be sent back to us for repair. Depending upon the nature of the problem, you may be responsible for some or part of the carriage charges.

We are unable to provide warranty against accidental damage or other Act of God. Where possible, we will endeavour to assist in cases of user error. However, if user error has resulted in a situation which requires significant time to be spent by RCI engineers reconstructing your system, we reserve the right to make an appropriate charge.

Once your machine has exceeded the 1 year warranty period, we will still endeavour to provide technical support services. Should you suffer hardware failure outside the period, you will be responsible for hardware costs, but labour fees will be kept to a minimum.

11. Liability

RCI shall not be held responsible for any result relating to the use or misuse of products supplied. Unless specified in writing, we do not make any claims of fitness for specific purposes, especially with regard to medical or similar mission critical applications. RCI shall not be held responsible for any financial losses which may be incurred by the Customer during use of products supplied by RCI.

12. Changes to Terms and Conditions

These Terms and Conditions may be subject to change from time to time. New orders will be subject to any revised Terms and Conditions. However, contracts concluded on the basis of previous terms and conditions remain unaffected.
